		<description>I thought the post and the comments were interesting but lose sight of the fact that the little guy was happy with the relevent traffic he had instead of 2 million porn seekers and copyright infringers.  Why should he have to sell it and move out of the way when he was there years ago?  

I heard he got an email from police demanding the take down of some kiddie porn which was really at Youtube.  Maybe he should wait until he&#039;s actually arrested and then sue Youtube eh?  American prosecutors could never convict an innocent person with no evidence could they?

Also, if he sells the traffic he&#039;ll be getting sued for sure.  I think he has a grip on internet marketing its just not the same one held by email spammers, search engine spammers and irrelevant traffic sellers.  He wants qualified traffic.

Saying a legal theory has not yet been endorsed by a federal circuit is not like saying it doesn&#039;t exist.  Numerous circuits have adopted initial interest confusion.  It is unfortunate that IP law is different in different parts of the U.S. but that&#039;s why we have appeals courts.  If youtube can sue others for initial interest confusion in the 9th circuit then I don&#039;t think a 6th circuit judge appeals court judge will have a problem using it against them.  I don&#039;t think it will be difficult to prove a &quot;likelihood of confusion&quot; when there are 2 million instances of actual confusion.  Even standard trademark infringement doesn&#039;t require an actual purchase.

Big companies have been taking domain names away from alleged cybersquatters for years.  Now that some little guy is in a position to use those same perverted decisions against big business he&#039;s seen as an opportunist.</description>

Out of 2 million views someone but be involved in industrial tubing!
Plus that kind of traffic is going to get you great search engine positioning!

UTube has obviously lost the plot, need a new web manager who can find a better ISP for their website, and get a grip on what web marketing is all about ... hell ... a grip on what any kind of marketing is!

This is a great example of the American obsession to sue for the sake of suing.</description>
